Copyright Exceptions

Whilst all possible efforts are made to ensure that copyright is correctly assigned and no material owned by or copyright to another is used without permission, other than under the provisions of 'Fair Use' (see below), errors and ommissions are expected. In the event that you find any material that is owned by or copyright to another and has been used without correct assignment of copyright please email stephenbooth@bigfoot.com identifying the material (URL of the page and a sufficient quotation of the material to correctly identify it), if you are or have a relationship to the copyright holder and what changes you deem required to correct the error or ommission, I shall endevour to make such changes as required as soon after being notified of a problem as possible. Where information is available from multiple (two or more) published sources it is assumed that the information itself is in the public domain although the sources themselves may be copyright to individual entities.

What is 'Fair Use'

The purpose of copyright is to protect the rights of creators of original works to profit from their efforts. Copyright prevents entities from making copies or broadcasting works created by others for their own profit or in a manner which infringes the creators ability to profit from their effort without gaining permission from (and usually paying a fee too) the owner/creator of that work. However there are situations where the law allows reasonable quotation of a copyrighted work.

'Fair Use' has a fairly strict definition. The relevant US statute clause, which gives a typical definition, is given below:


Sec. 107. Limitations on exclusive rights: Fair use Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole;
  4. and
  5. the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Copyrighted material on this site is used with the permission of the creator and/or for the purpose of criticism/review/parody and as such are covered by the provisions of Fair Use.

This site is registered with Buffy Watchlist with whom any infringements/theft of copyright will be lodged for arbitration.

 

Why there aren't many graphics on this site.

Many fan sites are loaded down with photographs, this is not one of those. The problem is that most of these are scanned from magazines or stolen from official sites and as such are copyrighted. Getting permission to use a photograph is a minefield of copyright as the magazine that published it may have bought it out right or may have just bought a license to use it for one issue or in a certain way and the copyright may still rest with the photographer or with a press photo bureau. Candid shots may be owned by the photographer or by the celbrity themselves, on-set shots may be owned by the photographer, studio or the celebrities shown. For that reason this site will only use photographs owned by the site author, that are in the public domain or where permission has been obtained from the copyright holder to publish them on this website. Similar conditions apply to video or audio files, except where such use could be considered to fall under the demense of 'Fair Use' as indicated above.

Links to other sites.

This site contains links to sites external to itself, authored by other people/bodies. The site owner makes no claims of ownership to material on those sites and makes no assertions as to the legality or copyright complaince of material on such sites. Links to such sites will be removed if those sites themselves are removed or undergo a change in character that negates the purpose of the link or if a copy of a court order made out by a Federal (for US) or Crown (for UK) Court judge (or equivelent in another nation) is made available to the site owner. The site owner reserves the right to ignore any such documents they believe to be forgeries or not properly notorized. Where exernal links exist they will usually be marked as such, unless the externality of the link is felt to be implicitly shown, although not so marking does not constitute any acceptance of liability.
